Naaatüüüürlich nicht - in Berufung zu gehen, ist absolut nicht persönlich, geht es doch um das Gesetz "dolus eventualis" was ja immer schon irgendwie falsch verstanden wurde und OP ist nun der perfekte Grund, dies endlich mal richtig zu stellen, schon klar. ;)Tussinelda schrieb:Oscar appeal not personal - NPA

The team prosecuting the R250 million drug trafficking trial in the Germiston Magistrate's Court made an unscheduled change to their witness list, in what the defence have described as a deliberate attempt to mislead them.
In a showdown yesterday, defence advocate Sita Kolbe SC accused Scorpions prosecutor Gerrie Nel of adding chief investigator Andrew Leask to the witness list at the last minute without informing the defence.
She saw this as a strategy to cause a delay in the evidence expected from witness Glenn Agliotti.
Leask was testifying in the case in which Stefanos Paparas, his elderly father Dimitrio and Stanley Poonin are accused of attempting to smuggle about 2 tons of hashish out of SA in 2006.
Self-confessed criminals Agliotti and Clinton Nassif are expected to be called as witnesses.
Yesterday, the State called Leask to the stand to explain the unfolding of the investigation into the drug trafficking syndicate - Project Coffee - an offshoot of the larger Project Bad Guy, which involved the prosecution of former police chief Jackie Selebi, recently convicted of corruption.
The move didn't sit well with Kolbe, who accused Nel of deliberately delaying proceedings as the matter had to stand down for about an hour for the State to take down Leask's affidavit.
Kolbe was also unhappy that Leask had been called as a witness.
"Mr Leask I have a problem with you testifying because you have been sitting in this court throughout the trial, listening to the evidence," Kolbe said.
She referred to the fact that Leask had also taken the stand in the Selebi trial and given evidence on certain facts that related to the Paparas matter.
She said Leask had told the Johannesburg High Court that private investigator Paul O'Sullivan - who was instrumental in the Project Bad Guys investigation - had ceased his involvement in the case in April 2006.
However, she challenged that his latest evidence in the Germiston court was that O'Sullivan had continued to assist after this.
Leask denied that he had contradicted himself.
Kolbe asked for the matter to stand down until today to allow her time to consult the Johannesburg High Court record of Leask's evidence in the Selebi trial, and match it with his latest evidence.
She had earlier taken on Nel outside the courtroom, accusing him of helping witnesses. In his defence, Nel said he never aided Dimpeng "Slang" Maangwale, a Scorpions agent who went undercover to investigate the drug trafficking syndicate.
"My lord, during the break I was accused of helping the witness by nodding my head... indicating to him to answer in a particular way, and I put it on record that I did no such thing," Nel said.

das kann ich fett und doppelt unterstreichen.. Nel und dem twitternden Prof Grant geht es doch nur um eigene Schadensbegrenzung..
